Paypal or card disputes


Any paypal or card dispute that is raised within 7 days of placing an order, will result in Darwen Home Decor delaying the dispatch of the item until the dispute is closed. If your item is in transit when a dispute is raised, we will contact the courier and recall the item. Once the dispute is closed, the product will be re-dispatched, the cost of the postage for re dispatch will be met by the customer.




Introduction


These terms and conditions apply to the use of this website, by accessing this website, and/or placing an order, you agree to be bound by the terms and conditions set out below. If you do not agree to be bound by these terms and conditions, you may not use or access this website. Before you place an order, if you have any questions regarding these terms and conditions, please contact our customer service team via live chat, available between 9am - 5pm, Monday to Friday.




Dispatch & transit


Orders placed before 2pm will be dispatched the same day. Orders placed after 2pm will be dispatched the next working day. Orders placed on a Saturday or Sunday will be assembled and dispatched in the order they were placed and may take more than 2 working day to dispatch. *During busy periods, dispatch times may vary and we cannot guarantee same day dispatch. However, we will aim to dispatch your order within 48 hours. **Hexagon, Accent shelves and tealight holders, are made to order, we do not carry a stock of these items, threrefore dispatch times may vary for these particular products. We will aim to dispatch your item within 4 working days. Orders will be couriered by MyHermes 3-5 Standard, standard P&P price as detailed on the order confirmation. MyHermes 3-5 Standard courier to; UK Mainland, Highland & Isles of Scotland, Isle of Man & Isle of Scilly & Channel Islands. All other destinations are priced on an individual basis, and are subject to change without notice. Please request a shipping quote via email (info@darwenhomedecor.co.uk) or live chat. Once dispatched, it is the customers responsibility to track the order, using the tracking number provided on the dispatch email. It is the responsibility of the customer to inform Darwen Home Decor, within 3 days of the expected delivery date, of a missing item. For any claims after 7 days, it is at the discretion of Darwen Home Decor as to whether a refund or replacement will be made. Any delays in transit will not result in a refund/replacement until the item has been declared lost by the courier. Darwen Home Decor will not launch and investigation into items lost in transit until a 7 working day time period has ellapsed from the expected devliery date. During public / bank holidays, dispatch times may vary.




Returns & refunds


If you are not entirely happy with your product and wish to return it to us, the cost of the return post and package will be met by the customer. No refunds will be made until we receive the product back. The return package must be sent via a fully tracked courier and a tracking link must be provided to Darwen Home Decor. If the item is lost or damaged in transit Darwen Home Decor is not liable, and no refund will be issued. We therefore reccommend you send your item full insured in order for you to recuperate any loses should any issues arise. Under the Consumer Rights Act (2015), returns will only be accepted within the standard 14 days. We may make a deduction from the reimbursement for loss in value of any good supplied if the loss is the result of unnecessary handling by the customer. Similarly any goods returned incomplete will result in a deduction from the reimburment. Refunds will then be issued (by the method you originally paid for the transaction) within 14 days or receiving the goods back. Faulty goods We always strive to provide the best quality products. However, if your product slips through our quality control processes, and you receive a faulty product, please inform us in writing (info@darwenhomedecor.co.uk or live chat) immediately. Otherwise within no more than 2 days or receiving the product. A clear image of the damage must be provided. For a refund or replacement to be issued, the faulty item must be returned to us. The post and packaging cost will be at the company's discretion. Items lost in transit Any claim for non delivery or shortages must be made, in writing (info@darwenhomedecor.co.uk or live chat) within 3 days of the expected delivery date. NO CLAIMS WILL BE REFUNDED AFTER THIS TIME PERIOD. Darwen Home Decor will not launch an investigation into items lost in transit until a 7 working day period has ellapsed from the expected delivery date. Items damaged in transit Any claim for an item damaged in transit must be made in writing (info@darwenhomedecor.co.uk or live chat) within two days of receiving the product.A clear image of the packaging and damage sustained must be provided.Darwen Home Decor will arrange for a return courier with MyHermes top return the damaged item.Cases will be looked at on an individual basis and the use of other couriers will be at the company's discretion.




Use of this website


You are provided with access to this website in accordance with these conditions. And any orders placed by you must be placed in accordance with these conditions. Registration You warrant that the personal data which you are required to provide when you register as a customer is true, accurate current and complete in all respects, and you will notify us immediately of any changes to your personal data by updating these details on your online account. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use. Our rights We reserve the right to: 1. Modify or withdraw temporarily or permanatly, this website, or part thereof. With of without notice to you, and you confirm that we shall not be liable to you or any third party for any modification to/or withdrawal of the website. 2. Make changes of terms on conditions from time to time, and your continued use of the website, or any part thereof, following such change shall be deemed to be your acceptance of such change. It is you responsibility to check regularly to determine whether the terms and conditions have been changed. If you do not agree to any change of the terms and conditions, then you must immediately stop using our website.




Correspondence


We always strive to keep our customers up to date should there be a delay with their order. Our system monitors correspondence and shows us if an email has been opened and read. Darwen Home Decor will not be held responsible for any delays in transit once correspondence has been sent updating the customer.




Customer Contact Information


The responsibility is solely on the customer to ensure all contact information provided to Darwen Home Decor is correct. If a partial or incorrect address is provided Darwen Home Decor will not be held responsible for any items that are lost in transit due to inaccurate information. If an incorrect contact email is provided, Darwen Home Decor will not be held responsible for any delays in dispatch or transit not being communicated to the customer.

Cancelling and changes orders


If you wish to cancel your order before your order has been dispatched, please do so in writing via live chat as soon as possible. Any cancellation requests after your item has been dispatched, will be dealt with in line with our returns and refund policy, and the cost of returning the goods will be met by the customer. You are entitled to cancel your order providing you exercise your right, no longer than 14 days after receiving your product. Your right to return or cancel products does not apply to goods that are made to measure, or are made to your specification. This does not affect your statutory rights if goods are faulty or not as described. If you wish to cancel, you should return the goods to us at your cost within 14 days of such cancellation. Refunds will then be issued (by the method you originally paid for the transaction) within 14 days or receiving the goods back. We may make a deduction from the reimbursement, for loss in value of any goods supplied, if the loss is the results of unnecessary handling by the customer.




Our Products


Our products are made from natural wood. Therefore, the wood may contain natural blemishes, such as knots. Please be aware we do not class the natural state of the wood as damage, and as such refunds will not be be issued for "faulty products" should the fault be a natural defect.
